"The Housing Developers Ordinance"
"Where is my free brochure on the
housinng accommodation?" - this is a question that all house purchasers
have the right to ask of their housing developer from 1 Jnuary
onwards.
The beginning of the years heralded
the passing of the Housing Developers (Control and Licensing) Ordinance
1993 in Sarawak.
How is the Housing Developers Ordinance
going to effect house building, selling and buying for the people?
Basically, the Ordinance and its
Regulations brings good tidings for everyone concerned - legitimacy
for housing developers and protection for house buyers.
In particular, house buyers can
now watch out for the following conditions before they purchase a house
from housing developers :
1. A housing developer must have a licence to construct 8 or more units
of housing.
Ensure that your housing developer has this licence
2. It is the duty of a licensed housing developer to display in the
office and branch office a copy of the last audited balance sheet and
information of those in control of the business.
Look for these exhibits in the office of your housing developer.
3. A licensed housing developer must have an advertisement and sale
permit before any advertisement or sale houses can be made.
Make sure that your housing developer has this permit before you buy
the house.
4. Each house buyer is entitled to a brochure regarding the housing
accommodation free of charge from the housing developer.
Do ask your housing developer for this brochure.
5. All sale and purchase agreement must follow the standard sale and
purchase agreement provided in the Ordinance.
Check that your sale and purchase agreement follos the standards.
6. The signatures of every party on the sale and purchase agreement
are required to be witnessed by an advocate or person authorised in
writing by the Controller.
Bear this fact in mind when you are going to sign the sale and purchase
agreement.
7. The housing developer is not allowed to collect any booking deposit
untik after the sale and purchase agreement are signed.
Give the necessary amount to your housing developer only when the sale
and purchase agreement is properly signed by all parties.
8. The house buyer is fully responsible for the stamp regostration and
legal fees arising from and in connection with the agreement.
Your housing developer does not have to pay these fees.
In addition to the above conditions, the Ordinance also provides for
the withdrawal of FPF contributions.
With all the rules and regulations under Sarawak Housing Developers
Ordinance, House buyers are given the opportunity to find out the true
merits of housing developers and their housing developments.
It also given an assurance to buyers of fair and uniform treatments
from housing developers. Therefore, exercise your rights while housing
hunting.
